1. Who we are

The loyalyou.ro website (the “Site”) is operated by ASPIRE ENTERPRISE S.R.L. (“LoyalYou”, “we”). The Romanian version of these terms is the binding one; this translation is provided for convenience.

2. Purpose of the Site

The Site presents the LoyalYou service: digital loyalty cards for Apple Wallet and Google Wallet and the companion business app. The information published is for information only and is not a binding offer.

The LoyalYou service is supplied to a business only under a separate written contract. Where the two differ, the contract prevails.

3. Acceptance

By accessing and using the Site you confirm that you have read, understood and accept these Terms and Conditions, the Privacy Policy and the Cookie Policy. If you do not agree, please do not use the Site.

4. The contact form

The “Request a demo” form does not send your data to our servers. Pressing the button opens WhatsApp with a pre-filled message, which you choose whether to send. You are responsible for the accuracy of the data you send and for not sending other people’s data without their consent.

Data we receive is processed according to the Privacy Policy.

5. Intellectual property

The Site’s content — text, graphics, logos, the LoyalYou name, design and source code — belongs to ASPIRE ENTERPRISE S.R.L. or its licensors and is protected by Romanian Law no. 8/1996 on copyright and by trademark law. Copying, reproducing or using it commercially without our written consent is prohibited.

Apple Wallet is a trademark of Apple Inc. and Google Wallet is a trademark of Google LLC. They are used on the Site for descriptive purposes only.

6. Permitted use

When using the Site you agree not to:

  • attempt to gain unauthorised access to the Site, its server or connected systems;
  • disrupt the Site (e.g. through excessive automated traffic, viruses or malicious code);
  • automatically extract content (scraping) for commercial purposes;
  • use the Site for unlawful purposes or in a way that infringes other people’s rights.

7. Limitation of liability

We make reasonable efforts to keep the Site’s information accurate and up to date and the Site available, but we do not guarantee uninterrupted or error-free operation. The Site is provided “as is”.

To the extent permitted by law, we are not liable for indirect damage resulting from use of the Site. This limitation does not apply to damage caused intentionally or through gross negligence (art. 1355 of the Romanian Civil Code) and does not affect your statutory rights as a consumer.

8. Third-party links

The Site may link to third-party sites or services (e.g. WhatsApp, the App Store, Google Play). We do not control and are not responsible for their content or policies.

9. Changes

We may update these terms. The version in force is the one published on this page, with the last-updated date shown above.

10. Governing law and disputes

These terms are governed by Romanian law. Any dispute will first be settled amicably; failing that, by the competent courts at the registered office of ASPIRE ENTERPRISE S.R.L., unless the law provides otherwise for consumers.
